Regulations
The Give BrightlySM Sweepstakes (the "Sweepstakes") will begin at 12 a.m. Eastern Time ("ET") on April 5, 2021 and ends at 11:59 p.m. ET on July 5, 2021 ("Promotion Period"). Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. The Sweepstakes is sponsored by CooperVision, Inc. ("Sponsor"), 209 High Point Drive #100, Victor, NY 14564.
Eligibility: The Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia, who have attained the age of majority in his or her state or territory of residence as of the time of entry. The Sponsor and its parents, affiliates, subsidiaries related companies and each of their respective employees, officers, shareholders, insurers, agents, representatives and charitable partners, any eye care professionals and their employees, the Sponsor’s advertising and promotion agencies including Born Collective (“Agency”) and American Sweepstakes & Promotion Co. Inc. (“Administrator”) (collectively, “Released Parties”) and members of the immediate family (mother, father, sons, daughters and spouse, regardless of where they reside) and household members of each, whether or not related, are not eligible to participate in the Sweepstakes. Participation constitutes entrant's full and unconditional agreement to and acceptance of these official rules. Void in Puerto Rico and where prohibited by law.
How to Enter: Eligible participants are invited to play the Give BrightlySM game by visiting the promotional website located at www.givebrightly.org which is hosted by Agency. They will first need to submit their name, email address and state of residence in the required fields along with choosing the local office of their eye care professional from a drop-down menu that will be prepopulated with the names of offices in the state they have chosen. Once the information is submitted, Entrants can then play the game which when completed will earn them one (1) Entry into the Sweepstakes. Entrants will then be provided with a unique link to play the game and are encouraged to share that URL link with their friends via Twitter, Facebook, SMS, or email. If one of their friends uses the unique, personal URL link to play the game, that original Entrant will earn one (1) additional entry for each of their friends that plays with their specific unique URL link, up to a maximum of fifty (50) total additional entries.
The Entrant may also receive one (1) additional bonus entry by either purchasing a CVI product and filling out a rebate form OR by completing and submitting an online survey that will be provided to them. Entrants who chose to purchase a CVI product will not be able to receive the additional bonus entry by taking the survey and those who take the survey will not be able to earn the additional entry through a CVI product purchase. The maximum number of entries allowed per person is fifty-two (52) which may be comprised of the one (1) entry for playing the game, the fifty (50) entries for unique personal URL link game plays and the one (1) bonus entry for a CVI product purchase OR survey completion. The CVI product purchase will be confirmed once the Entrant completes and submits a rebate form for the purchase of the product.
Once submitted, an entry cannot be deleted, canceled, or modified. Any violation or attempt to violate this restriction may cause Agency to disqualify all such entrant’s eligible entries. Proof of sending an entry will not be deemed to be proof of receipt by Agency. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor which are final and binding in all matters relating to the Sweepstakes. Entrants agree that each entry becomes the property of Agency and any personally identifiable information collected by Agency during an entrant's participation in this Sweepstakes may be used for purposes of the proper administration and fulfillment of the Sweepstakes as described in these Official Rules.
Drawing and Notifications: One (1) Grand Prize winner, five (5) Second Place Prize winners and ten (10) Third Place Prize winners will be selected in a random drawing from all eligible entries received on or about July 12, 2021. The random drawing will be conducted by the Administrator, an independent judging organization, whose decisions are final and binding in all matters relating to this Sweepstakes. Odds of winning a prize will depend on the total number of eligible entries received during the Promotion Period. Prize winners will be contacted by the email address that they provided at the time of entry by either the Administrator or the Agency.
Released Parties shall have no liability for any winner notification that is lost, intercepted, or not received by a potential winner for any reason. If a prize or prize notification is returned as unclaimed or undeliverable to a potential winner, if potential winner cannot be reached within three (3) calendar days from the first notification attempt, or if potential winner fails to return requisite document(s) within the specified time period, or if a potential winner is not in compliance with these Official Rules, then such person shall be disqualified, and an alternate winner may be selected for the prize at issue.
Prizes: One (1) Grand Prize winner will receive a 12.9-inch iPad Pro with 125GB that has an Approximate Retail Value (ARV) of $899.99. Five (5) Second Place Prizes will receive an annual supply of CVI clariti® 1 day sphere contacts with an ARV of $560, and as applicable, costs for a contact lens fitting and prescription for the clariti® 1 day lenses up to, but not to exceed, $70. Total ARV of Second Place Prize not to exceed $630. If a Second Place winner elects not to accept the annual supply of clariti® 1 day lenses they may choose a gift card in the value of $550, which will be issued by a third party and subject to the third party’s accompanying terms and conditions. Ten (10) Third Place Prize winners will each receive designer sunglasses that have an ARV of $300 a pair. The total prize pool Approximate Retail Value not to exceed $7,049.99.
Prize Conditions: By accepting a prize, the winner agrees to release and hold harmless the Released Parties from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of a prize. All potential winners must sign and return to the Administrator, within seven (7) days of the date of notice or attempted notice is sent, an Affidavit of Eligibility, Liability & Publicity Release in order to claim his/her prize. Note: The Grand Prize Winner and the Second Place Prize winners who accept the annual supply of clariti® 1 day lenses will also be required to provide their Social Security Number on the Affidavit of Eligibility, Liability & Publicity Release to the Administrator, which will be used solely for tax reporting purposes. The Grand Prize winner and these Second Place Prize winners must note that the value of their accepted prize is taxable as income and an IRS Form 1099 will be filed in their name for the value of the prize. All Winners are solely responsible for all matters relating to a prize after it is awarded and will be responsible for any local, state, and federal taxes, if applicable, associated with the receipt of a prize. If a prize or prize notification is returned as unclaimed or undeliverable to a potential Winner, if a potential Winner cannot be reached within three (3) business days from the first notification attempt, or if a potential Winner fails to return requisite document(s) within the specified time period, or if a potential Winner is not in compliance with these Official Rules, then such person shall be disqualified and, at Sponsor’s sole discretion, an alternate Winner may be selected. Except as expressly noted with respect to second place winners, no substitution or transfer of prize or election of cash in lieu of prize will be permitted. The Sponsor reserves the right at its sole discretion to substitute any prize with another prize of equal or greater value if the prize (or any component thereof is not available.
General Liability Release / Force Majeure: By accepting a Prize, where permitted by law, recipient grants to the Sponsor its parent, subsidiaries and related companies, and those acting pursuant to the authority of Sponsor (which grant will be confirmed in writing upon Sponsor’s request), the right to print, publish, broadcast and use worldwide IN ALL MEDIA without limitation at any time the recipient’s full name, portrait, picture, voice, likeness and/or biographical information for advertising, trade and promotional purposes without further payment or additional consideration, and without review, approval or notification. IN NO EVENT WILL RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS SWEEPSTAKES OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZES. By participating, entrants release and agree to hold harmless the Released Parties from any and all liability for any injuries, death or losses or damages to persons or property AS WELL AS CLAIMS/ACTIONS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY that may arise from participating in this Sweepstakes or its related activities or the acceptance, possession, use or misuse of, or any harm resulting from the acceptance, possession, use or misuse of the Prize(s). Winner acknowledges that Sponsor has neither made nor is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact, or in law, relative to the Prize.
Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions, or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security and/or feasibility of the Sweepstakes as contemplated herein. In the event an insufficient number of eligible entries are received and/or Sponsor is prevented from awarding prizes or continuing with the Sweepstakes as contemplated herein by any event beyond its control, including but not limited to fire, flood, a natural or man-made epidemic of health or other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g. Covid-19), order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select the winner in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances.

By participating in the Sweepstakes and providing your e-mail address, entrants hereby agree to Agency’s collection and usage of their personal information and acknowledge that they have read and accepted Agency’s Privacy Policy and agree to receive email communications relating to this Sweepstakes.
Disputes: Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the federal or state courts located in Monroe County in the State of New York. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor, Agency or Administrator in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
